Obviously, the European Union trademark ca no longer be used as a protection tool (except for EU trademarks filed/registered by 31 December 2020), but it is surely possible to file a trademark application to the United Kingdom Intellectual Property Office (UK IPO).
Before starting the registration proceeding, it is always advisable to rely on an experienced professional in trademarks, considering that not all signs can be registered as trademarks according to the law. It is also highly advisable to carry out a trademark search before filing the trademark application, especially since in the UK it is accepted a letter of consent issued by the owner of an earlier trademark potentially conflicting with yours.
After the filing of the trademark application, the UK IPO verifies that the application complies with the legal requirements for registration and performs a search of trademarks identical with and similar to the proposed application, which have been filed or registered for identical or similar products or services. If the Office finds any conflicting marks or has any other objections to registering the mark then it will issue an examination report inviting observations and arguments against the objections.
The Trademark Office does not reject applications on the basis of conflicting marks, but if any citations of earlier marks cannot be overcome by argument and the application is allowed to publication, then the Office will write to the owners of the cited registrations inviting them to oppose the application.
The application will be published in the Trademark Journal for 2 months, during which anyone can oppose it.
If no opposition is filed (or if it is overcome), marks are currently proceeding to registration around 3/5 months from filing.
The trademark has a duration of ten years and it is potentially renewable indefinitely for equal periods of time.
