{"id":9424,"date":"2018-10-09T15:58:01","date_gmt":"2018-10-09T13:58:01","guid":{"rendered":"https:\/\/registrare-marchio.com\/?p=9424"},"modified":"2018-10-09T15:58:28","modified_gmt":"2018-10-09T13:58:28","slug":"tsg-what-you-should-know-in-case-of-registration","status":"publish","type":"post","link":"https:\/\/registrare-marchio.com\/en\/tsg-what-you-should-know-in-case-of-registration\/","title":{"rendered":"TSG: what you should know in case of registration"},"content":{"rendered":"<p>Do you know that a trademark cannot be in conflict with <strong>traditional specialities guaranteed<\/strong> (<strong>TSG<\/strong>)?<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-9425\" src=\"https:\/\/registrare-marchio.com\/wp-content\/uploads\/2018\/10\/what-is-tsg.jpg\" alt=\"TSG: what you should know in case of registration\" width=\"465\" height=\"290\" srcset=\"https:\/\/registrare-marchio.com\/wp-content\/uploads\/2018\/10\/what-is-tsg.jpg 465w, https:\/\/registrare-marchio.com\/wp-content\/uploads\/2018\/10\/what-is-tsg-300x187.jpg 300w, https:\/\/registrare-marchio.com\/wp-content\/uploads\/2018\/10\/what-is-tsg-280x175.jpg 280w\" sizes=\"auto, (max-width: 465px) 100vw, 465px\" \/><\/p>\n<p><div id=\"toc-np-container\"><p id=\"toc-np-title\">In this post we talk about:<\/p><ul class=\"no-bullets\"><li class=\"header-level-1\"><a href=\"https:\/\/registrare-marchio.com\/en\/tsg-what-you-should-know-in-case-of-registration\/#What-are-traditional-specialties-guaranteed\">What are traditional specialties guaranteed<\/a><\/li><li class=\"header-level-1\"><a href=\"https:\/\/registrare-marchio.com\/en\/tsg-what-you-should-know-in-case-of-registration\/#Why-are-these-specialties-defined-as-traditional\">Why are these specialties defined as \u201ctraditional\u201d<\/a><\/li><li class=\"header-level-1\"><a href=\"https:\/\/registrare-marchio.com\/en\/tsg-what-you-should-know-in-case-of-registration\/#What-is-the-difference-between-TSG-PDO-and-PGI\">What is the difference between TSG, PDO and PGI?<\/a><\/li><li class=\"header-level-1\"><a href=\"https:\/\/registrare-marchio.com\/en\/tsg-what-you-should-know-in-case-of-registration\/#Suggestions\">Suggestions<\/a><\/li><\/ul><\/div><\/p>\n<p>Article 7, 1, l) EUTMR provides that the following shall not be registered:<\/p>\n<blockquote><p>\u201cTrademarks which are excluded from registration pursuant to Union legislation or international agreements to which the Union is party, providing for protection of traditional specialities guaranteed\u201d.<\/p><\/blockquote>\n<p>The above means that<strong> the <a href=\"https:\/\/registrare-marchio.com\/en\/registering-a-trademark-in-the-european-union\/\">registration of an EUTM application<\/a> should be refused<\/strong>, or <a href=\"https:\/\/registrare-marchio.com\/en\/invalid-trademark-and-revocation\/\"><strong>the registration of an EUTM invalidated<\/strong><\/a> if there is <strong>conflict with a TSG<\/strong>.<\/p>\n<h2><span id=\"What-are-traditional-specialties-guaranteed\">What are traditional specialties guaranteed<\/span><\/h2>\n<p>First of all, it is a recognition given by the European Union and <strong>the traditional speciality guaranteed must comply with a product specification<\/strong>.<\/p>\n<p>They are names which describe a specific product or foodstuff that results from <strong>a mode of production, processing or composition corresponding to traditional practice<\/strong> for that product or foodstuff or which are produced from raw materials or ingredients that are those traditionally used.<\/p>\n<p>Two examples of traditional specialities guaranteed in which the traditional characteristic of the product is in their production are famous Spanish ham \u201c<strong>Jam\u00f3n Serrano<\/strong>\u201d, produced in accordance with a traditional method of salting and aging and our beloved \u201c<strong>pizza napoletana<\/strong>\u201d, only when produced with specific ingredients (among them extra virgin olive oil and peeled tomatoes and\/or fresh tomatoes) in accordance with a specific method (among the rules there is that the pizza should be worked only by hand and that it should rest two hours at least).<\/p>\n<p>Speaking of Italy, \u201c<strong>mozzarella<\/strong>\u201d has also obtained the recognition of STG: it must be exclusively a fresh pasta pulled-curd cheese, derived exclusively from whole cow\u2019s milk and that respect a specific production process (described in the product specification).<\/p>\n<h2><span id=\"Why-are-these-specialties-defined-as-traditional\">Why are these specialties defined as \u201ctraditional\u201d<\/span><\/h2>\n<p>The answer is that they are products of which it is possible <strong>to demonstrate a usage on the domestic market for a period that allows transmission between generations<\/strong>; this period is to be at least <strong>30 years<\/strong>.<\/p>\n<h2><span id=\"What-is-the-difference-between-TSG-PDO-and-PGI\">What is the difference between TSG, PDO and PGI?<\/span><\/h2>\n<p>They are signs created by the European Union to promote and protect quality agricultural and foods products.<\/p>\n<p>A <strong>PDO (designation of origin)<\/strong> is a name that identifies a product originating in a specific place, region or, in exceptional cases, a country, whose quality or characteristics are essentially or exclusively due to a particular geographical environment with its inherent natural and human factors and the production steps of which all take place in the defined geographical area.<\/p>\n<p>A<strong> geographical indication<\/strong> is a name that identifies a product originating in a specifi place, region or country, whose given quality, reputation or other characteristics is essentially attributable to its geographical origin and of which at least one of the production steps takes place in the defined geographical area.<\/p>\n<p><strong>TSG<\/strong> are, as above said, traditional specialties guaranteed.<\/p>\n<p><a href=\"https:\/\/registrare-marchio.com\/en\/pdo-pgi-tsg\/\"><strong>Italy stands out for the quality of products in the tree categories<\/strong>.<\/a><\/p>\n<h2><span id=\"Suggestions\">Suggestions<\/span><\/h2>\n<p>As you can see, it is essential that a<strong> trademark is not in conflict non only with identical and\/or similar earlier trademarks<\/strong>, but also with a large list of prior distinctive signs, <strong>among which the TSG<\/strong>.<\/p>\n<p>There is a <a href=\"https:\/\/www.politicheagricole.it\/flex\/cm\/pages\/ServeBLOB.php\/L\/IT\/IDPagina\/2090\" target=\"_blank\" rel=\"noopener\"><strong>list of TSG in the European<\/strong><\/a> are which <strong>should be consulted before registering your trademark<\/strong>.
