{"id":8805,"date":"2018-06-17T20:47:44","date_gmt":"2018-06-17T18:47:44","guid":{"rendered":"https:\/\/registrare-marchio.com\/?p=8805"},"modified":"2018-06-25T13:13:31","modified_gmt":"2018-06-25T11:13:31","slug":"it-is-forbidden-to-exploit-images-of-cultural-heritage-for-profit","status":"publish","type":"post","link":"https:\/\/registrare-marchio.com\/en\/it-is-forbidden-to-exploit-images-of-cultural-heritage-for-profit\/","title":{"rendered":"It is forbidden to exploit images of Cultural Heritage for profit"},"content":{"rendered":"<p>The article 108 of Legislative Decree 42\/2004 (Code of the Cultural Heritage) makes subject to concession the reproduction of cultural assets for profit purposes. <strong>In fact, reproduction is free only if it is carried out without profit.<\/strong><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-8843\" src=\"https:\/\/registrare-marchio.com\/wp-content\/uploads\/2018\/06\/Cultural-Heritage.jpg\" alt=\"Cultural Heritage\" width=\"465\" height=\"290\" srcset=\"https:\/\/registrare-marchio.com\/wp-content\/uploads\/2018\/06\/Cultural-Heritage.jpg 465w, https:\/\/registrare-marchio.com\/wp-content\/uploads\/2018\/06\/Cultural-Heritage-300x187.jpg 300w, https:\/\/registrare-marchio.com\/wp-content\/uploads\/2018\/06\/Cultural-Heritage-280x175.jpg 280w\" sizes=\"auto, (max-width: 465px) 100vw, 465px\" \/><\/p>\n<p>In this case, a travel agency used the<strong> image of Michelangelo\u2019s David for commercial purposes<\/strong> without ever trying to obtain the concession from the authority that has the property in hand, undoubtedly identifiable in the Gallery of the Academy in Florence.<\/p>\n<p>The Court of Florence, by order dated October 26, 2017 (RG.N. 13758\/2017), stated, with reference to a travel agency which used the name and image of Michelangelo\u2019s David for publicizing its business, <strong>the ban of use and reproduce on all the Italian and European territory of said image on flyers, sites and souvenirs,<\/strong> in the lack of authorization from the Galleria dell\u2019Accademia of Florence<\/p>\n<p>In the order the Court of Florence also ordered<\/p>\n<blockquote><p>\u201cthe immediate withdrawal from trade and the destruction of all advertising material reproducing the image of Michelangelo\u2019s David or parts of it, as well as all the tools used to produce and\/or commercialize such products, everything with reference both to the company and to third parties which hold and\/or have, however, the availability of such goods\u201d.<\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>The law forbids exploiting cultural heritage images for profit.
