{"id":6829,"date":"2018-03-29T14:07:54","date_gmt":"2018-03-29T12:07:54","guid":{"rendered":"http:\/\/registrare-marchio.com\/nuovo\/?p=6829"},"modified":"2020-11-11T14:35:43","modified_gmt":"2020-11-11T13:35:43","slug":"why-to-register-a-trademark","status":"publish","type":"post","link":"https:\/\/registrare-marchio.com\/en\/why-to-register-a-trademark\/","title":{"rendered":"Why to Register a Trademark"},"content":{"rendered":"<p>Registering trademark is essential, because, with globalization and the wide spread of the internet, the traditional commercial and geographical coordinates are often overcome and <strong>a trademark can easily be subject <a href='https:\/\/registrare-marchio.com\/en\/\/trademark-infringement-and-damages-in-italy\/' class='' title='' target=''>to abuse and counterfeiting<\/a>.<\/strong><\/p>\n<p><img src='https:\/\/registrare-marchio.com\/\/wp-content\/uploads\/2018\/03\/why-to-register-a-trademark.jpg' class='aligncenter' alt='Why to register a trademrk?' width='465' height='290'\/><br \/>\nIn this regard it is useful to know that, in principle and subject to verification in the country where you intent to use your brand,<strong> nothing prevents you from using your brand without activating any registration procedure.<\/strong><\/p>\n<p>Anyhow, it is good to know that:<\/p>\n<ul>\n<li>In some States <a href='https:\/\/registrare-marchio.com\/en\/\/unregistered-trademark-and-local-preuse\/' class='' title='' target=''><strong>simple use<\/strong><\/a> of the (unregistered) trademark is not recognized and does not give you any right;<\/li>\n<li>Your trademark will be commercially more attractive if it <a href='https:\/\/registrare-marchio.com\/en\/\/filing-and-registering-a-trademark-differences\/' class='' title='' target=''><strong>is registered (or at least filed)<\/strong><\/a>, in all cases where you decide to make it the subject of commercial transactions, for example in the case of <strong>transfer of ownership<\/strong> (<a href='https:\/\/registrare-marchio.com\/en\/\/trademark-assignment\/' class='' title='' target=''><strong>trademark assignment agreement<\/strong><\/a>) or if you grant its use to a third party (<a href='https:\/\/registrare-marchio.com\/en\/\/trademark-license-agreement\/' class='' title='' target=''><strong>trademark license agreement<\/strong><\/a>);<\/li>\n<li>It is easier to <a href='https:\/\/registrare-marchio.com\/en\/\/trademark-opposition-proceedings\/' class='' title='' target=''><strong>contest the use and filing of a confusingly similar trademark<\/strong><\/a> if you are the owner of a filed\/registered trademark.
