According to the Trademarks Law of Morocco, a trademark means a sign capable of graphic representation which serves to distinguish the goods or services of a natural or legal person<\/strong>. In particular, may constitute such a sign:<\/p>\n An application of trademark<\/strong><\/a> can cover more classes of goods and\/or services. Also Morocco adopts Nice classification for trademark registration<\/strong><\/a>.<\/p>\n The application for registration shall be subject to publication and an opposition<\/strong><\/a> may be filed within a period of two months from the date of publication.<\/p>\n After two months from publication and if no opposition has occurred, the brand is registered and a certificate of registration is issued.<\/p>\n The term of duration of the registered<\/strong> <\/a>mark shall be ten years from the application date<\/strong> and can be renewed indefinitely, each time for ten years.<\/p>\n An owner who has not put his mark to genuine use<\/strong> in connection with the goods or services covered by the registration during an uninterrupted period of five years, without good reason, shall be liable to revocation of his rights.<\/p>\n The following shall be assimilated to use:<\/p>\n According to the Trademark Law of Morocco, the rights under a registered mark may be transferred in whole or in part.<\/p>\n They may be subject, in whole or part, to the granting of an exclusive or non-exclusive license<\/strong><\/a>.<\/p>\n Acts involving transfer or licensing<\/strong><\/a> shall be recorded in writing on pain of nullity<\/strong><\/a>.<\/p>\n\n
