But is that really the case?<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-11285 aligncenter\" src=\"https:\/\/registrare-marchio.com\/wp-content\/uploads\/2020\/03\/fack-ju-gothe-eng.jpg\" alt=\"marchio non registrabile perch\u00e9 contrario ai principi morali accettati\" width=\"465\" height=\"290\" srcset=\"https:\/\/registrare-marchio.com\/wp-content\/uploads\/2020\/03\/fack-ju-gothe-eng.jpg 465w, https:\/\/registrare-marchio.com\/wp-content\/uploads\/2020\/03\/fack-ju-gothe-eng-300x187.jpg 300w, https:\/\/registrare-marchio.com\/wp-content\/uploads\/2020\/03\/fack-ju-gothe-eng-280x175.jpg 280w\" sizes=\"auto, (max-width: 465px) 100vw, 465px\" \/><\/p>\n<p>&nbsp;<\/p>\n<p>In this case the trademark\u00a0 is \u00a0&#8220;<strong>Fack Ju Gohte<\/strong>&#8221; and I am sure that it recalls you something, both for the &#8220;fack Ju&#8221; and for the &#8220;Gohte&#8221;; In fact, both the EUIPO and the General Court considered the same <strong>not registrable because contrary to accepted principles of morality<\/strong>, but the EU Court of Justice showed a different opinion (<strong>decision of 27 February 2020, C-240\/18 P<\/strong>).<\/p>\n<p>Let\u2019s go to see the reasons and let\u2019s try to understand why there are different decisions.<\/p>\n<h2><span id=\"EUIPO-decision-and-General-Court-judgement-stating-the-sign-is-NOT-able-to-be-registered\">EUIPO decision and General Court judgement stating the sign is NOT able to be registered<\/span><\/h2>\n<p>EUIPO and General Court, after having verified the identity of pronunciation between \u201c<em>fuck you<\/em>\u201d and \u201c<em>fack ju<\/em>\u201d, considered that the two expressions have the same meaning, offensive and trivial, all the more because they are associated with the name (modified but still recognizable) of the famous German writer.<\/p>\n<p>Neither EUIPO nor the EU Court attributed any importance to the fact that the trademark in question reproduced the title of a cinematographic comedy very well known to the German public, which was moreover produced by the same company that filed the application for the <a href=\"https:\/\/registrare-marchio.com\/en\/filing-and-registering-a-trademark-differences\/\"><strong>registration of the trademark<\/strong><\/a>.<\/p>\n<h2><span id=\"The-opinion-of-the-Court-of-Justice-on-the-registration-of-the-trademark\">The opinion of the Court of Justice on the registration of the trademark<\/span><\/h2>\n<p>On the contrary, Court of Justice stated that:<\/p>\n<blockquote><p>\u201cthe film was a great success in German-speaking countries, <strong>apparently without stirring much of a controversy as to its title<\/strong>; the film title was duly authorised and released for screening to younger audiences; and the positive perception of the film can also be evidenced by its incorporation into the learning programme of the <strong><a href=\"https:\/\/www.goethe.de\/en\/index.html\">Goethe-Institut<\/a><\/strong>\u201d<\/p><\/blockquote>\n<p>Court of Justice concludes that: (paragraph 68)<\/p>\n<blockquote><p>\u201cIt should therefore be noted that all of these contextual factors consistently indicate that, despite the assimilation of the terms <em>\u2018Fack ju<\/em>\u2019 to the English phrase \u2018<em>Fuck you\u2019<\/em>, <strong>the title of the comedies was not perceived as morally unacceptable by the German-speaking public at large<\/strong>. It should also be noted in that connection that the perception of that English phrase by the German-speaking public is not necessarily the same as the perception thereof by the English-speaking public, even if it is well known to the German-speaking public and the latter knows its meaning, since sensitivity in the mother tongue may be greater than in a foreign language. For the same reason, the German-speaking public also does not necessarily perceive the English phrase in the same way as it would perceive the German translation of it.\u201d<\/p><\/blockquote>\n<p><strong>Which lessons can we draw from this judgement? <\/strong><\/p>\n<p>Two, at least.<\/p>\n<p>Firstly <strong>law is not a mathematical formula<\/strong> and that each case must be assessed in the complexity of all its elements: <strong>what appears obvious at frist glance may not to be such after careful consideration of all the circumstances<\/strong>.<\/p>\n<p>Secondly, that most of all when you have logically sustainable arguments, it must be rememberde that that <strong>there are more degreed of judgements<\/strong>, therefore we invite you to<\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #ff6600;\"><strong>always evaluate with your trademark lawyer the possibility of continuing in the various degrees of judgement, even when you have had an unfavorable decision.<\/strong><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>When  determining whether a trademark can be registered or not, many elements are examined, some of which can overturn previous and diametrically opposed opinions.<\/p>\n","protected":false},"author":3,"featured_media":11285,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[106,103],"tags":[],"class_list":["post-11284","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-case-law-and-trademark","category-european-union-trademark"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Not registrable trademark?
