Let\u2019s try to give you some answers.<\/p>\n<p><img src='https:\/\/registrare-marchio.com\/\/wp-content\/uploads\/2018\/03\/trademark-opposition.jpg' class='aligncenter' alt='trademark opposition' width='465' height='290'\/><\/p>\n<p><div id=\"toc-np-container\"><p id=\"toc-np-title\">In this post we talk about:<\/p><ul class=\"no-bullets\"><li class=\"header-level-1\"><a href=\"https:\/\/registrare-marchio.com\/en\/trademark-legal-assistance\/trademark-opposition-proceedings\/#What-trademark-opposition-proceedings-are\">What trademark opposition proceedings are<\/a><\/li><li class=\"header-level-1\"><a href=\"https:\/\/registrare-marchio.com\/en\/trademark-legal-assistance\/trademark-opposition-proceedings\/#Is-it-always-possible-to-file-an-opposition\">Is it always possible to file an opposition?<\/a><\/li><li class=\"header-level-1\"><a href=\"https:\/\/registrare-marchio.com\/en\/trademark-legal-assistance\/trademark-opposition-proceedings\/#Does-trademark-opposition-exist-Worlwide-with-identical-rules\">Does trademark opposition exist Worlwide with identical rules?<\/a><\/li><li class=\"header-level-1\"><a href=\"https:\/\/registrare-marchio.com\/en\/trademark-legal-assistance\/trademark-opposition-proceedings\/#Is-it-possible-to-claim-compensation-if-an-opposition-is-won\">Is it possible to claim compensation if an opposition is won?<\/a><\/li><li class=\"header-level-1\"><a href=\"https:\/\/registrare-marchio.com\/en\/trademark-legal-assistance\/trademark-opposition-proceedings\/#Eva-Troiani-Law-firm-advice-and-legal-assistance\">Eva Troiani Law firm: advice and legal assistance<\/a><\/li><\/ul><\/div><\/p>\n<h2><span id=\"What-trademark-opposition-proceedings-are\">What trademark opposition proceedings are<\/span><\/h2>\n<p>Trademark opposition allows the proprietor of a trademark (and sometimes also the exclusive licensee of a trademark and the holders of other rights, such the right to the name) <strong>to oppose the registration of a later trademark<\/strong> in some cases which are variable according to the State and which will be studied by examining the relevant legislation.<\/p>\n<p>It is usually possible to lodge an <strong>opposition against <a href=\"https:\/\/registrare-marchio.com\/en\/similar-trademarks-find-out-how-the-comparison-is-done\/\">trademarks which are identical with or similar to yours<\/a><\/strong>, which have been filed for <a href=\"https:\/\/registrare-marchio.com\/en\/judgment-of-affinity-between-products\/\"><strong>identical or similar products or services<\/strong><\/a> and that may create confusion in the public.<br \/>\nThrough the opposition the opposing party asks the examiner not to grant the registration of the opposed trademark.<br \/>\nIn some States the opposition can be filed only after the registration, with the aim of cancelling the registration.<\/p>\n<h2><span id=\"Is-it-always-possible-to-file-an-opposition\">Is it always possible to file an opposition?<\/span><\/h2>\n<p>No, it is not always possible to file an opposition.<br \/>\nThe law provides for a <strong>deadline<\/strong>, usually short, <strong>within which the opposition can be filed<\/strong>; therefore, for example, if you wish to file an opposition against an Italian or European Union trademark, you have to bear in mind that you can do so only within three months from the date of publication of such trademarks on the Trademark Gazette.<\/p>\n<h2><span id=\"Does-trademark-opposition-exist-Worlwide-with-identical-rules\">Does trademark opposition exist Worlwide with identical rules?<\/span><\/h2>\n<p><strong>No, some States do not provide for trademark opposition.<\/strong><br \/>\nAt the same time, there are differences concerning possible grounds of the opposition, time of the opposition and to whom the opposition must be filed.<\/p>\n<h2><span id=\"Is-it-possible-to-claim-compensation-if-an-opposition-is-won\"><b>Is it possible to claim compensation if an opposition is won?<\/b><\/span><\/h2>\n<p>The question is generic, so first of all we give you our reply for the case of the Italian opposition (taking place to the <strong><a href=\"http:\/\/www.uibm.gov.it\/index.php\/inglese\" target=\"_blank\" rel=\"noopener noreferrer\">UIBM<\/a>, acronym for the Italian Patent and Trademark Office<\/strong>) and for the EU opposition, taking place to the <strong><a href=\"https:\/\/euipo.europa.eu\/ohimportal\/en\/home\" target=\"_blank\" rel=\"noopener noreferrer\">EUIPO<\/a>, acronym for the European Union Intellectual Property Office<\/strong>).<\/p>\n<p><strong>Certainly no compensation can be claimed during an opposition proceeding.<\/strong><\/p>\n<p>Opposition\u2019 s purpose is not obtaining compensation, but <strong>preventing a third-party\u2019s trademark \u2013 which is deemed to be in conflict with yours- \u00a0from being registered<\/strong>. During an opposition, a claim for damage is not allowed.<\/p>\n<p>A claim for damages must necessarily be proposed with an action which is autonomous and independent from the opposition.<\/p>\n<p>To complete the answer, we add that no compensation can even be requested elsewhere, if we wish to base our claims only on the acceptance of our opposition.
