The Italian Ministry of Health, following the recommendations and directives of the European Union, has done a national trademark compliant with the requirements defined for common logo (community trademark 1162865) which identifies each pharmacy or shop that on-line sells medicinal products to the public.
Logo on-line sales medicinal products
A single digital copy of logo, non-transferable, is given by the Ministry of Health to each pharmacy or shop authorized, by the region or autonomous province or by other competent authorities, to supply on-line medicinal products to the public.
According to the Article 1,3) of the Decree of 6 July 2015, the national logo must be clearly visible on each page of the website of authorized pharmacies or shops dedicated to the sale of medicines without obligation of prescription.
According to Article 2 of the abovementioned Decree, no one can use the logo, outside of the subjects individually authorizes and it is not allowed neither for itself nor for others to rent, lease, assign or transfer in any way any type of right related to the common logo and to the national logo to third parties.
Furthermore, it is not possible to change the appearance of the common logo or of the national logo, as well as it is not possible to create, develop and/or use derivations or variations based on any part thereof, except that to increase or decrease, in a proportional way, the size of the national logo.
